good day to all!

my first for 2010!

question lang po!

what do we do if we later discovered that the item/s delivered by a winning bidder (sole) is proven 'overpriced'?

what do we do with the deliveries? performance bond?

first of all you already agreed on the price when you signed the contract you cant do anything about it. Many scenario may arise from your question.

It is possible that

1. The items was purchased with other several items. The prices of other items (we can call B) maybe much lower than that of the original price of the complained item (lets call this A) and the bidder adjusted the prices ex. A is 15 pesos (market price) B is 15 pesos (market price) but in the bidding he claimed a 20 pesos B and 10 pesos A.

2.The PE has no market research on the prices on the item before he/she entered the procurement process.

I can`t conclude anything without knowing the facts behind the procurement process.

I can only say that if such procurement undergo a competitive bidding, you have no other alternative but to continue the contract under such procurement.
