Can a Store owned by a plublic employee submit QUOTATION (RFQ)

I am an employee of DPWH and I own a small store and my wife manage it. Am I allowed to join bidding or submit quotation at Other DPWH District Engineering Office (not same DISTRICT where I was working.)?

taken from number 6 of the Omnibus Sworn Statement, "The owner or sole proprietor is not related to the Head of the Procuring Entity, members of the Bids and Awards Committee (BAC), the Technical Working Group, and the BAC Secretariat, the head of the Project Management Office or the end-user unit, and the project consultants by consanguinity or affinity up to the third civil degree"

if you will not fall under the above excerpt, i think you can.

unless if you have a relative in that office, you can not submit a quotation in that office. by the way, kanino po nakapangalan ang business nyo po? dapat din hindi po sa inyo sir kasi public employee po kayo. Thanks!

Ayon po sa GPPB Non-Policy Opinion - NPM NO. 061-2017 as i QUOTE:

Requesting Entity: LOCAL GOVERNMENT UNIT OF SANTA MARIA, ROMBLON

Issues Concern: Elective Official as Bidder

Details
(1) Can a firm owned and/or managed by an elective official who is not the Head of the Procuring Entity (HoPE) participate in the procurement process as a bidder.


As a general rule, an entity owned and/or managed by an elective official can participate in the procurement opportunities of government provided that it complies with all the requirements prescribed under the 2016 revised Implementing Rules and Regulations (IRR) of Republic Act (RA) No. 9184, the Government Procurement Reform Act, except in the procuring entity where the elective official serves. The prohibition against a firm owned and managed by an elective official participating in the procurement within the elective official`s agency on the ground of conflict of interest is anchored on Section 3(i) of Republic Act No. 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees."

Ayon naman po sa Section 3(i) of RA No. 6713 or the Code of Conduct and Ethical Standards for Public Officials and Employees as i quote again:

"(i) "Conflict of interest" arises when a public official or employee is a member of a board, an officer, or a substantial stockholder of a private corporation or owner or has a substantial interest in a business, and the interest of such corporation or business, or his rights or duties therein, may be opposed to or affected by the faithful performance of official duty."

Ito po ay isang sharing of information lamang na sana'y kahit papano makatutulong po sa inyo.
