I would like to inquire if the BAC may require ITR for the past three years.  Would there be no violation on this?

these are additional requirements which are prohibited by the procurement law. You only require additional documents if it is permits and licenses required by law and stated in the bidding documents. the procurement has already streamlined the requirements in order to promote efficiency and reduce cost of doing business.

In the ITB Clause 29.2(a) : Only tax returns filed and taxes paid through the BIR Electronic Filing and Payment System (EFPS) shall be accepted.

Note: The latest income and business tax returns are those within the last six months preceding the date of bid submission.


--- May I ask as to what will be the scenario for those (like us) who paid and filed Income Tax Return annually, what will happen to the other six months that lapses? Can we still participate in the bidding though our ITR lapsed the required six months?
