customized agency procurement manual

what happens now to the customized agency procurement manual? is the revisions under the new 9184 not apply unless the CAM is also revised?

The customized manual (as approved by the GPPB) follows the prevailing IRR. It substitutes the Generic Procurement Manual on some respects but the entire IRR is still being followed. All provisions of the Customized Procurement Manual not consistent with the Revised IRR shall be repealed accordingly. It's back to square one. It's back to (updated) Generic Procurement Manual (if available) or to the most basic - the Revised IRR itself. Smile

To Applepie;
I do not know your agency but for DEPED, I have not read yet any provision in our Customized Agency Procurement Manual that contravenes any provision of the Revised IRR of RA 9184 and I agree with Engrjhez in his statement that if ever their are provisions in your Customized Agency Procurement Manual that is against any provision of the law, you should point this out to your agency so that this can be corrected immediately lest this will create confusion in your agency.

It may be necessary to amend the Customized Agency Manuals in order to harmonize it with the changes in the Revised IRR of 9184.

engrjhez, i thought the revised IRR is made to "dismantle" procurement manuals of every agency? i still remember the GPPB battlecry, "No A's nor B's" but one IRR. If the GPPB shall allow another Customized Procurement Manual for every agency, would it not create another confusion?

True.

But the creation of customized procurement manuals is not actually a necessity or not even mandatory in nature. "ek-ek" lang kumbaga. The CAM is just a reiteration of the IRR - made simpler. That is not supposed to be confused because if ever conflict shall arise between the CAM and the IRR, the latter shall prevail. What do we expect from a CAM?

1. Specific provisions for NGAs, GOCCs or LGUs shall be highlighted; with irrelevan sections omitted;
2. Specific structure of the BAC as applicable to the agency concerned;
3. Specific informations on allowed bid and performance securities shall be identified clearly and more categorically;
4. Other general provisions that may be specifically addressed.

This will eventually simplify the IRR into "easily digestible" manual. We are actually trying to make one by ourselves hopefully before the year ends. This will surely be part of our exercise (and challenge) to improve our knowledge on procurement law - and hope this succeeds! Very Happy
