PREPARATION OF BIDDING DOCUMENT

Who is in charge of preparing the PBDs. Is it the BAC Secretariat? or the TWG wherein the proponent is always a member? or Is it the proponent only? Your opinon is very much appreciated. Thanks

Quoting Sec.17.1:
17.1. The Bidding Documents shall be prepared by the procuring entity following the standard forms and manuals prescribed by the GPPB. x x x

This means that it is not lodged solely to the BAC, the BAC Secretariat, TWG, End User or Implementing Unit. It is an undertaking for the PROCURING ENTITY as a whole. This is how it should be:

End User/Implementing Unit (EU/IU): prepares and sets the schedule of requirements, Bill of Quantities (BoQ), Scope of Works (SoW), Terms of Reference (ToR) and technical specifications in support for the PPMP which was the basis of APP.

BAC-TWG: checks the correctness and appropriateness of the submitted schedule of requirements, Bill of Quantities (BoQ), Scope of Works (SoW), Terms of Reference (ToR) and technical specifications and coordinate with the EU/IU. The (arithmetical) computations as reflected in the Purchase Request (PR) in support of the such submittal shall also be checked at this point

BAC: Provides the rest of supplementary details to complete the Bidding Documents such as Invitation to Bid, BDS, SCC, BoQ, SoW, and ToR as appropriate. Approves the content and coordinate with the BAC Sec for its final documentations. The BAC also sets the procurement milestones and timelines consistent with the schedules reflected in the PPMP and APP.

BAC Sec: Prepares the electronic (and printed) copy following the endorsement of the BAC. The BAC Sec shall be the primary contact person as reflected in the Bidding Documents and may include additional sample forms (in the last part of the document) that may be useful for prospective bidders. The BAC Sec also manages the sale and distribution of Bidding Documents.

excerpts from GPM volume 2 page 24 for your guidance. (For Goods/infra)
The following must participate in the preparation of the bidding documents:
1. The BAC;
2. The TWG;
3. The end-user unit/PMO;
4. Consultants, if any; and
5. The BAC Secretariat / Procurement Unit.

Hi!
I would also like to ask if the private entity can use the standard form of the BID DOCS? Does RA 9184 is also applicable for private sectors who would like to conduct a public bidding for a certain project?

You can to that madam. But of course you don't need to follow other provisions such as posting to philgeps of the bidding and award which are not applicable to private entity.

You need to post in the PhilGEPS (www.philgeps.gov.ph), and conspicuous places. To be able to post into the PhilGEPS no have to register first if you are not yet registered.

Good Day!!! I would like to ask: What if other documents such as PCAB License, BIR Cert. of Registration and Philgeps Registration is not included in the envelopes provided by the bidder. Is it the fault of the BAC Secretariat for forgetting to tell it to the bidders even though the BAC provided the instruction to bidders and the general conditions of the contract. Thank you.

No. It is not even the function of the BAC Secretariat (to remind the bidders of the requirements).

Note:
BIR Certificate of Registration is neither an eligibility nor a post qualification requirement. PhilGEPS registration certificate on the other hand is a requirement only on the post qualification process.
