What I see is that there is no valid posting in any of the two postings made. There should be at least 20 cd (Refer to Annex "C") before the BAC can declare of failure (no bidder). And even after that, mandatory review of the terms and conditions is warranted (Sec.35.2). So both procedures may be void. Smile

do we have to repeat the same process again? or we resort to alternative methods like negotiated contract?

You only resort to alternative methods upon (1) prior approval from HOPE and (2) whenever justified by the conditions of the IRR. Further, the method of procurement must be clearly stipulated in the APP of your agency.

Since the 2-failed bidding scenario is invalid, you cannot use Sec.53.1. I recommend you conduct Public Bidding again following the time lines as prescribed in Annex "C". Smile
