LGU Procurement of Multi-Year Contract for Road Rehabilitation/Maintenance

Hi GPPB,

How do you undertake LGU procurement of multi-year contract for road rehabilitation/maintenance?

From what I've seen in various laws, GPPB Opinions, COA & DBM Circulars, LGU procurement of multi-year contracts is allowed for ICT, janitorial and security services, as well as real property leases. But these statutes are silent on LGU multi-year contracting of civil works (such as road rehabilitation and maintenance),or for that matter, services other than what is already allowed by the said statutes.

The NGAs have their MYOAs, and the GOCCs, their charters as bases for budgeting of multi-year contracting. But how about the LGUs? What similar documents should they rely on if they are to undertake multi-year contracting.

Welcome to this forum, PRMF

For LGUs, the LCE can enter to any and all agreements provided that he/she is authorized by the Sanggunian as the corporate representative. Because of this autonomy, there is no limitation as the number of years entered into provided that the contract terms and conditions are not disadvantageous to the LGU and if it involves purely its own resources. Smile
